1. Acceptance of Terms
By accessing, submitting information to, or purchasing properties, leads, or services from HSE Buyers, you (“Buyer”) agree to be bound by these Terms & Conditions. If you do not agree, do not use our services.
2. Nature of Services
HSE Buyers provides access to real estate opportunities, including but not limited to:
Off-market properties
Wholesale opportunities
Property information and/or leads
HSE Buyers is not acting as a real estate broker, agent, or fiduciary, unless explicitly stated in writing.
3. Buyer Responsibility & Due Diligence
Buyer understands and agrees that:
All properties and information are provided AS-IS and WHERE-IS
Buyer is solely responsible for all due diligence, inspections, title review, valuations, legal review, and financing
No guarantees are made regarding property condition, ARV, rents, occupancy, or investment performance
4. No Guarantees or Warranties
HSE Buyers makes no representations or warranties, express or implied, including but not limited to:
Accuracy or completeness of property data
Profitability, returns, or resale outcomes
Property condition, zoning, or legal status
All figures and estimates are for informational purposes only.
5. Non-Circumvention
Buyer agrees not to bypass or circumvent HSE Buyers, including but not limited to:
Contacting sellers, owners, or sources introduced by HSE Buyers without consent
Sharing or distributing property information to third parties
Violation may result in immediate termination of access and legal action.
6. Fees, Deposits & Payments
All fees, deposits, and payments made to HSE Buyers are non-refundable unless otherwise stated in writing
Buyer is responsible for meeting all contractual timelines, including earnest money and closing deadlines
Failure to close does not entitle Buyer to any refund
7. Confidentiality
All information provided by HSE Buyers is confidential and intended solely for Buyer’s evaluation. Unauthorized disclosure is prohibited.
8. Limitation of Liability
To the fullest extent permitted by law:
HSE Buyers shall not be liable for any direct, indirect, incidental, or consequential damages
Total liability, if any, shall not exceed the amount paid by Buyer to HSE Buyers for the specific transaction or service
9. Indemnification
Buyer agrees to indemnify and hold harmless HSE Buyers, its owners, affiliates, and representatives from any claims, losses, or damages arising from Buyer’s actions, decisions, or use of provided information.
10. Termination
HSE Buyers reserves the right to suspend or terminate Buyer access at any time for violation of these Terms or misuse of information.
11. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Arizona, without regard to conflict of law principles.
12. Modifications
HSE Buyers may update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
